Terms of Use

Last updated: [PUBLICATION DATE]

Draft: the passages in square brackets are to be filled in before publication.

1. Publisher

Somméo is published by [PUBLISHER’S FULL NAME], sole trader (French micro-entreprise), [ADDRESS], SIRET [NUMBER]. Contact: [CONTACT E-MAIL].

By using the app, you accept these terms.

2. What Somméo does

Somméo listens to your nights to pick out snoring, breathing and noise, works out a score and shows you what was going on outside on those nights. Detections are estimates made from sound: they can be wrong.

3. Not a medical device

Somméo informs. It diagnoses no condition, does not treat and does not replace a doctor. If your sleep or your health worries you, see a healthcare professional. Do not change a treatment because of what the app shows.

4. Account

An account is optional. If you create one, you are responsible for access to your mailbox or to your Apple or Google account. You can delete your account at any time from the profile.

5. Free version and Premium

The free version gives the score, the detail of the latest night and seven days of history. Premium adds the full history and the analyses.

  • Prices: shown in the app before you buy, in your App Store’s currency.
  • Free trial: when one is offered, its length is stated before you buy. The paid subscription starts when the trial ends, unless you cancel at least 24 hours before.
  • Renewal: the subscription renews automatically for the same length, at the price then in force, unless you cancel at least 24 hours before the end of the period.
  • Cancelling: in your App Store account settings. Premium stays on until the end of the period you paid for.
  • Payment and refunds: handled by Apple, under its own terms. Refund requests go to Apple.

6. What you may and may not do

You get a personal, non-exclusive, non-transferable right to use the app. You agree not to use it to listen to someone without their knowledge, not to try to get around its limits or extract its code, and to follow the law.

If someone sleeps in the same room, tell them: they have a right to know that the sound of the room is analysed. Sound clips are on unless you turn them off: short recordings of the room, which may include their voice, are then kept on your phone. Keep them only with their agreement, or turn them off in your profile.

7. Your data

It is described in the privacy policy. Your nights are yours: you can export and delete them at any time.

8. Availability

The app depends on your phone, its microphone, its battery and third-party services (weather, account, App Store). The system may interrupt a recording. The built-in alarm is a help: do not rely on it alone for something important.

9. Liability

Somméo is provided with care, but without any guarantee that detections are accurate or that the service is uninterrupted. To the extent the law allows, the publisher’s liability is limited to direct and foreseeable damage, and to the amount you paid over the last twelve months. Nothing in these terms removes rights the law gives consumers.

10. Changes and ending

These terms may change; a significant change will be announced in the app before it applies. You can stop using Somméo at any time. The publisher may suspend an account used against these terms.

11. Governing law and disputes

These terms are governed by French law, without depriving you of the protective provisions of the law of the country where you live. In case of a dispute, write first to [CONTACT E-MAIL].
